Data Overview: FY 24-25
OPHD is dedicated to raising awareness within the UC San Diego community about its efforts to address harassment and discrimination under the UC Policies on Anti-Discrimination and Sexual Violence and Sexual Harassment (SVSH). In balancing transparency with the need to maintain privacy for all parties involved, OPHD shares information in aggregate form to prevent the identification of individual incidents or parties.
This data is based on a fiscal year (FY) cycle, from July 1, 2024, to June 30, 2025.
OPHD reviews data at different levels - by Report, Complaint, Policy, and Issue. More than one issue and/or policy may be included in the same complaint. Use this flowchart whenever you need help navigating the other charts.
Keys to Understanding this Overview
OPHD conducts an initial assessment of each report received by:
- Providing resources and support: Sharing information about OPHD processes and available resources, inviting the Complainant (person who experienced the concern) to meet.
- Reviewing relevant information: Examining intake notes, supporting documents, and prior case records.
- Gathering additional information: Reaching out to relevant units or stakeholders to collect more information, if needed.
- Assessing next steps: Evaluating safety concerns, considering interim measures, and taking into account the Complainant's desired outcome (if known).
- Communicating with participating Complainants: Informing the Complainant about the outcome of the initial assessment and next steps.
OPHD resolution process refers to:
- Alternative Resolution: A voluntary, non‑disciplinary, and non‑investigative approach (guided by University policies and OPHD’s assessment) that seeks a mutually agreed‑upon outcome such as mediation, training, or restorative practices, without OPHD conducting an investigation or determining violations of policy.
- Formal Investigation: A structured investigative procedure that begins after an initial assessment when Alternative Resolution is inappropriate or declined, featuring written notice of allegations, an assigned investigator, interviews, evidence collection, and a written report that applies a preponderance‑of‑evidence standard to determine responsibility and possible disciplinary action.

Other Inquiry: Occurs when a report is not closed after initial assessment yet is not appropriate for Alternative Resolution or Formal Investigation. OPHD will conduct an inquiry to clarify what occurred and promptly take actions designed to stop any substantiated conduct, prevent its recurrence, and, when appropriate, remedy its effects.

Of the 1730 Issues reported to OPHD:

41% (707) under the UC Policy on Anti-Discrimination;

39% (668) under the UC Policy on Sexual Violence and Sexual Harassment;

0% (5) under Conflicts of Interest Arising out of Consensual Relationships (PPM 200-11);

20% (350) did not fall under these policies, and thus were outside of OPHD's purview to address.

When an issue falls outside OPHD's purview but may be addressed by other University policies, OPHD may refer the matter to appropriate University personnel or provide parties with additional reporting options.

Of the 1660 complaints OPHD closed:

9% (149) resolved via Preventative Measures;

If an initial assessment does not support an OPHD resolution process, the report may be closed. Alternatively, OPHD may take preventative measures to address the concern, such as:

A Prevention & Education meeting to share individualized feedback with the Respondent (subject of concern)

Of the 2019 issues OPHD assessed:

46% (930) had insufficient information;
-
37% (742) were not eligible for an OPHD resolution Process;

12% (249) fell outside of OPHD jurisdiction;

4% (70) concluded with Formal Investigation;

1% (28) involved a Complainant who declined to proceed.

There are several reasons why a reported issue may not move forward with an OPHD resolution process. These include:
-
Insufficient information: not enough details to take action (not knowing who made the complaint, who is accused, Complainant does not engage with OPHD).

Not eligible for resolution process: After review, OPHD finds the reported conduct does not meet a policy definition of prohibited conduct. A resolution process is not available, but OPHD may still offer education, preventative measures, or support.

No jurisdiction: OPHD does not have the authority to address the issue (it may involve people or a location not affiliated with the University).

Complainant declines to proceed: The person making the complaint chooses not to move forward with a resolution process.

Formal Investigations Completed by Outcome FY 24-25

Of the 45 investigations OPHD completed in FY 24-25:

56% (25) resulted in no policy violation findings;

42% (19) resulted in policy violation findings;

2% (1) was terminated prior to conclusion.

As a single investigation may include multiple issues that result in different findings:

Policy Violation Found: the investigation included at least one policy violation (and may have multiple violations)

Policy Violation Not Found: the investigation did not include any findings of policy violations

Investigation Terminated: a significant change in circumstances has so impaired the investigation that OPHD cannot reliably determine whether the alleged conduct occurred
